Bankruptcy in Malaysia: The RM100,000 Threshold, How to Check Your Status, What You Lose, and How Discharge Works
Bankruptcy is the word debt collectors use to frighten people and the outcome most borrowers misunderstand in both directions: some assume one missed loan payment leads to it, others ignore court papers until it has already happened. This guide sets out how bankruptcy actually works under the Insolvency Act 1967, who can be made bankrupt and for how much, how to check your own status, what life as an undischarged bankrupt involves, the three routes to discharge, and what borrowing looks like afterwards.
- A creditor needs a judgment debt of at least RM100,000 to petition for your bankruptcy. Unpaid loans below that are pursued through ordinary civil enforcement.
- You can check your status online through the Insolvency Department’s e-Insolvensi search or your CTOS report.
- Bankruptcy is not permanent. Automatic discharge after three years, DGI discharge after five, or court discharge on application.
- The seven days after a bankruptcy notice are the last cheap moment to act. Respond to court papers; silence is what makes bankrupts.

Who Can Be Made Bankrupt, and for How Much
Under the Insolvency Act 1967, a creditor may present a bankruptcy (muflis) petition against an individual only if the debt owed is RM100,000 or more. The figure was raised from RM50,000 by the Insolvency (Amendment) Act 2020. The debt must be a liquidated sum, in practice a court judgment, and the creditor must first serve a bankruptcy notice that you fail to comply with.
Three points follow from that. First, a single personal loan of RM20,000 or RM50,000 cannot by itself be the basis of a bankruptcy petition, although it can certainly be the basis of a judgment, garnishee orders, and seizure of assets. Second, debts to the same creditor are added together, two or more creditors can petition jointly, and interest, late charges, and legal costs count towards the figure. Third, a debtor can also petition for their own bankruptcy, which some people do when debts are hopeless and creditors are many.
Social guarantors, meaning people who guaranteed an education loan, a personal vehicle hire purchase, or a housing loan without profit, cannot be made bankrupt for that guarantee at all. Other guarantors can be, but only after the creditor shows it has exhausted recovery against the borrower. See our guide for loan guarantors.
How to Check Your Bankruptcy Status
Insolvency Department online search. The Malaysian Department of Insolvency (MdI, Jabatan Insolvensi Malaysia) provides a bankruptcy search through its e-Insolvensi portal. Enter the MyKad number, pay the search fee, and the result shows whether a bankruptcy order exists and, where relevant, the discharge. The same search can be done over the counter at any MdI branch.
CTOS report. Bankruptcy orders and discharges are public records that CTOS collects, so your own CTOS report will show them. This is also how lenders find out, which is why a bankruptcy you did not know about can surface as a string of unexplained declines. Our guide to checking your CCRIS and CTOS report shows how to pull it.
If you find an order you did not expect, contact the MdI branch handling your case immediately. Petitions served by substituted service, for example by advertisement, can result in orders the debtor never saw. The window to appeal the order is 30 days from the order, not from when you found out; an application to annul can be made later but becomes harder with delay.
The Process, Stage by Stage
- 1
Judgment
The creditor sues and obtains a court judgment for the debt. This is where most defences must be raised.
- 2
Bankruptcy notice
If the judgment debt is RM100,000 or more and unpaid, the creditor serves a bankruptcy notice. You have seven days to pay, secure, or compound the debt, or to apply to set the notice aside.
- 3
Creditor’s petition
Failure to comply with the notice is an "act of bankruptcy". The creditor files a petition, which is served on you and heard by the High Court.
- 4
Bankruptcy order
If the court is satisfied, it makes a bankruptcy order (previously called receiving and adjudication orders). From this date your assets vest in the DGI.
- 5
Statement of affairs
You must submit a sworn statement of your assets, liabilities, income, and creditors to the DGI within 21 days of the order. The three-year automatic discharge clock runs from this submission, which is one more reason not to delay it.
- 6
Administration
The DGI realises assets, sets your monthly contribution, and distributes to creditors. You attend to obligations, keep the DGI informed, and seek permission where the Act requires it.
- 7
Discharge
By automatic discharge, DGI certificate, or court order. After discharge the remaining provable debts are released, with exceptions such as certain fines and maintenance.
The stages before the bankruptcy notice are the ordinary debt recovery process described in our guide on what happens when you cannot pay a personal loan. Most defaults never get past judgment and enforcement; bankruptcy is the end of a long road, not the first stop.
What an Undischarged Bankrupt Cannot Do
From the date of the order until discharge, the Director General of Insolvency (DGI) administers your financial affairs. The restrictions are practical, not symbolic.
Assets vest in the DGI
Property, vehicles, investments, and savings beyond what is allowed for living expenses are administered by the DGI for creditors.
Monthly contribution from income
You keep working, but the DGI sets an amount you must pay towards your debts each month, based on your income and dependants.
Bank accounts and credit
Accounts are frozen pending DGI instructions. Credit of RM1,000 or more cannot be obtained without disclosing bankruptcy. Cards are cancelled.
Travel
Leaving Malaysia requires permission from the DGI or the court. Passports may be surrendered.
Business and directorships
No acting as a company director or managing a company without court leave. Sole-proprietor businesses need DGI consent to continue.
Employment and licences
Some professions, public positions, and licences restrict undischarged bankrupts. Check your professional body or employer’s rules.
Public record
Bankruptcy is searchable through MdI and reported on CTOS. The discharge is recorded too, but the history remains visible for some years.
Obtaining credit of RM1,000 or more without telling the lender you are an undischarged bankrupt is a criminal offence under the Act. No bank or responsible licensed lender will lend to an undischarged bankrupt in any case, because the status is on CTOS. An offer of a loan that does not ask is not an offer from someone behaving like a licensed lender. Our guide to personal loan scams covers how these operate.
The Three Routes to Discharge
Discharge releases you from the provable debts in the bankruptcy and ends the DGI’s control of your affairs. The 2017 and 2023 amendments to the Insolvency Act made discharge considerably easier to reach than it used to be, particularly for bankrupts with smaller debts who cooperate.
| Route | When | Conditions |
|---|---|---|
| Automatic discharge | Three years after submitting your statement of affairs | Target contribution paid, obligations complied with. Creditors may object within a limited window, but the 2017 and 2023 amendments removed the right to object for bankrupts whose total debts do not exceed RM50,000, social guarantors, and bankrupts who are deceased, disabled, or medically incapable. The 2023 amendment also extended automatic discharge to those made bankrupt before 2017. |
| Certificate of discharge by the DGI | Generally after five years from the bankruptcy order | The DGI is satisfied with your conduct and cooperation. No court application needed; creditors are notified and may object on limited grounds. |
| Discharge by court order | On application at any time | The court weighs your conduct, the cause of bankruptcy, and creditor views. Used where the automatic and DGI routes are not available or are opposed. |
Discharge rules differ according to when the bankruptcy order was made and the total debt, and the Act has been amended several times. Confirm which route applies to you with the MdI branch handling your case or a lawyer.
What speeds discharge up is the same in every route: submit the statement of affairs on time, pay the monthly contribution the DGI sets, attend when called, keep the DGI informed of any change in income or address, and do not acquire assets or credit without permission. Non-cooperation is the most common reason discharge is delayed or opposed.
Loans and Credit After Discharge
Discharge ends the legal restrictions, but not the record. CTOS shows that you were bankrupt and when you were discharged, and lenders can see it for several years afterwards. Banks generally treat a discharged bankrupt as high risk for a long time and may decline unsecured credit outright. Licensed money lenders assess current income and conduct, and some will consider a small, short loan once there is a period of stable salary credits and nothing adverse since discharge.
- 1Get the discharge certificate or court order and keep it. You will be asked for it.
- 2Open a basic savings account and have your salary credited there every month. Six to twelve months of visible, stable income is the foundation.
- 3Pull your CTOS report and check the bankruptcy is marked as discharged. Dispute errors through CTOS.
- 4Rebuild conduct without new debt first: a bank account with regular salary credits, utilities and phone bills paid on time, and a secured or prepaid card if a bank offers one.
- 5Borrow only when there is a genuine need and your DSR clearly supports it. A small, short facility paid on time then helps the record; a loan taken just to rebuild credit does not justify its cost.
- 6Apply to one lender at a time; a cluster of declines after discharge sets the rebuild back.

Stopping It Before It Happens
Almost every bankruptcy order has a point, months earlier, where a letter went unanswered. These are the steps that keep a debt problem in the civil recovery lane and out of the High Court.
- Respond to every letter of demand and court paper. A judgment entered in your absence is the foundation of a bankruptcy petition.
- If you receive a bankruptcy notice, you have seven days. Pay, negotiate a secured arrangement, or apply to set it aside with legal advice. Do not let the period lapse.
- Propose a repayment plan to the creditor in writing. Creditors prefer a workable plan to a bankrupt debtor making a modest monthly contribution for years.
- Consider a Voluntary Arrangement. The Insolvency Act allows a debtor to propose, through a licensed nominee, a court-supervised repayment arrangement that binds creditors who approve it and stays bankruptcy proceedings while it runs. It is the statutory alternative to bankruptcy and is under-used.
- Use AKPK for bank debts. The Debt Management Programme is free and restructures facilities from BNM-regulated institutions into one payment, often removing the basis for a petition.
- Check whether you are a social guarantor. If the debt is a guarantee of an education, personal vehicle, or housing loan given without profit, a bankruptcy petition cannot be brought against you.
- Seek legal aid early. The Legal Aid Department and Bar Council legal aid centres assist people who cannot afford a lawyer; the Insolvency Department also provides public information.
If you have been served with a bankruptcy notice or petition, this is the point to get a lawyer, not after the order. The grounds to set a notice aside, to oppose a petition, or later to annul an order are technical and time-limited. The cost of advice at this stage is a fraction of the cost of three years as an undischarged bankrupt.
Where Are You in This?
Receiving demands: respond and propose a plan, and use AKPK for bank debts. Served with a notice or petition: get legal advice this week. Already bankrupt: cooperate with the DGI; it is the fastest route out. Discharged: rebuild with stable income and one small facility before applying for more.
This article is general information about Malaysian insolvency law, not legal advice. The Insolvency Act 1967 has been amended several times, most recently in 2023, and thresholds, discharge rules, and procedures change. Confirm your position with the Malaysian Department of Insolvency or a lawyer before acting.
Frequently Asked Questions
What is the bankruptcy threshold in Malaysia?
A creditor can only petition to make you bankrupt if you owe at least RM100,000. The threshold was raised from RM50,000 by the Insolvency (Amendment) Act 2020. In practice the route is a judgment debt: the creditor sues, obtains judgment, serves a bankruptcy notice, and petitions only if you fail to comply within seven days. A single personal loan rarely reaches RM100,000 on its own, but debts to the same creditor are aggregated, two or more creditors can petition jointly, and interest and costs count towards the figure.
How do I check if I am bankrupt in Malaysia?
The Malaysian Department of Insolvency (MdI, Jabatan Insolvensi Malaysia) offers an online bankruptcy search through its e-Insolvensi portal for a small fee per search, using the person's MyKad number. You can also check your CTOS report, which records bankruptcy and discharge status, or visit any MdI branch. If you have received court papers you do not understand, do the search immediately; many people discover a bankruptcy order only when a bank account is frozen.
What happens to my salary and bank account when I am made bankrupt?
Your assets vest in the Director General of Insolvency (DGI), who administers them for creditors. You can continue to work, but you must declare your income and pay a monthly contribution set by the DGI towards your debts. Bank accounts are generally frozen pending the DGI's instructions, and operating an account requires permission. You keep what the DGI allows for reasonable living expenses for you and your dependants.
Can a bankrupt travel overseas or run a business?
Not without permission. A bankrupt must obtain the DGI's or the court's consent to leave Malaysia, and the passport may be held. A bankrupt cannot be a company director or manage a company without court leave, and cannot carry on a business under another name without disclosing the bankruptcy. Certain professions and licences are also affected; check the rules of your professional body.
Can a bankrupt take a loan?
Obtaining credit of RM1,000 or more without disclosing that you are an undischarged bankrupt is an offence under the Insolvency Act. In practice, no bank or responsible licensed lender will lend to an undischarged bankrupt, because the status appears on CTOS and the DGI controls the person's finances. Anyone offering a loan to a bankrupt without asking is not behaving like a licensed lender. Borrowing becomes possible again only after discharge, and then gradually.
How does a bankrupt get discharged in Malaysia?
There are three routes. Automatic discharge: three years after you submit your statement of affairs, if you have paid the target contribution and complied with your obligations, subject to the creditor-objection rules that the 2017 and 2023 amendments narrowed. Discharge by the DGI's certificate: generally available after five years from the bankruptcy order where the DGI is satisfied with your conduct. Discharge by court order: on application at any time, where the court considers it appropriate. Which route applies depends on when you were made bankrupt and how much you owe.
Can I get a loan after being discharged from bankruptcy?
Eventually, yes. The discharge is recorded on CTOS and lenders can see that you were bankrupt for some years afterwards. Banks generally treat a discharged bankrupt as high risk for a long period. Licensed money lenders assess income and current conduct and may consider a small loan sooner, but expect to show stable income and a clean record since discharge. Rebuild with a basic savings account, then a small facility paid on time, before applying for anything substantial.
Borrow Responsibly — Things to Consider First
- A personal loan is a debt with interest. Understand the full APR, total repayment, and tenure before you commit — not just the monthly figure.
- Borrow only what you genuinely need. A larger loan or longer tenure means more total interest paid.
- Keep your total monthly commitments within a comfortable debt-service ratio so repayment does not strain essentials.
- Missed or late payments can lead to extra charges and affect your CCRIS/CTOS record and future borrowing.
