Loan Guarantor in Malaysia: What You Are Liable For, Your Rights, and How to Get Released

A brother, a colleague, a close friend asks you to “just sign as guarantor”. The form is two pages and the lender says it is a formality. It is not. This guide explains what a guarantor in Malaysia actually takes on under the Contracts Act 1950, how the guarantee appears on your own credit record, the protection the Insolvency Act gives some guarantors and not others, the questions to ask before you sign, and the only ways out once you have.

Key takeaways
  • You are liable for the whole debt, including interest and recovery costs, and usually without the lender having to chase the borrower first.
  • The guarantee shows on your CCRIS and follows you into your own loan applications.
  • Only “social guarantors” are protected from bankruptcy. A personal loan guarantor is not one.
  • You cannot walk away from the existing balance. Release needs the lender’s written agreement, a substitute, or settlement; only future advances under a continuing guarantee can be stopped by notice.

What a Guarantor Is Actually Liable For

A guarantee is a contract between you and the lender in which you promise to pay if the borrower does not. Under the Contracts Act 1950 your liability is co-extensive with the borrower’s: whatever the borrower owes under the facility, you owe too, unless the guarantee itself narrows it. In most standard forms it does not.

ItemCovered?Notes
Outstanding principalYesThe full unpaid balance, not the amount outstanding when you signed.
Interest and late payment chargesYesEverything that has accrued under the loan agreement, including after default.
Recovery and legal costsYesMost guarantee forms make you liable for the lender’s costs of enforcing the debt.
Future top-ups or new loansDependsDepends on whether it is a "specific" guarantee for one facility or a "continuing" guarantee. Read the heading and the first clause.
The borrower’s other debtsNoA guarantee covers only the facility named in it. Other loans the borrower holds are not your problem.

Two phrases in the document decide how far this reaches. A specific guarantee covers one facility for a stated amount. A continuing guarantee covers all present and future borrowing on the account, so a top-up the borrower takes two years later, which you never heard about, is also yours. If you are going to sign at all, sign a specific guarantee.

Most guarantee forms also make you a principal debtor, which lets the lender demand payment from you directly on default rather than suing the borrower first. The Contracts Act allows this. The practical effect is that the first letter you receive may be a demand for the full balance, not a courtesy notice.

How a Guarantee Appears on Your CCRIS

Your CCRIS report, maintained by Bank Negara Malaysia, has a section for facilities on which you are a guarantor, separate from your own borrowings. Banks see it directly, and a CTOS report pulled with your consent can include it, so licensed lenders see it too.

While the borrower pays on time, the guaranteed loan is generally not added to your own Debt-Service Ratio. But lenders know what a guarantee is, and a large guaranteed facility can reduce the amount they are willing to lend you. If the borrower misses payments, that conduct appears against your name, and your own applications start being declined for arrears you did not cause.

Check your own report before and after signing so you know what lenders see. Our guide to checking your CCRIS and CTOS report shows how, and the DSR guide explains how a contingent commitment can be treated.

Social Guarantors and Bankruptcy Protection

The Insolvency Act 1967 draws a line that most people have never heard of until it matters. A social guarantor is someone who gave a guarantee, without making a profit from it, for one of three things:

  • A loan, scholarship, or grant for educational or research purposes
  • A hire purchase loan for a vehicle for the borrower’s personal, non-business use
  • A housing loan for a home the borrower lives in

Social guarantor

Cannot be made bankrupt for the guaranteed debt. The creditor can still sue you and enforce a judgment against your assets and income, but bankruptcy proceedings are barred.

Any other guarantor

Including a personal loan or business loan guarantor. A creditor can petition for your bankruptcy once the debt reaches the RM100,000 threshold, but only with the court’s leave and after showing it has exhausted all avenues of recovery against the borrower first.

A personal loan guarantor is not a social guarantor. The “exhaust all avenues” requirement is real protection, but it delays bankruptcy rather than preventing it. For what bankruptcy involves, see our guide to bankruptcy in Malaysia.

Your Rights as a Guarantor

The Contracts Act does not only impose obligations. It gives guarantors five rights worth knowing before you need them. In practice you can also ask the lender for the current balance and conduct of the guaranteed facility; do so in writing and regularly.

1

Right of indemnity

Whatever you pay the lender as guarantor, you are entitled to recover from the borrower. The guarantee is between you and the lender, but the borrower owes you the money back.

2

Right of subrogation

Once you have paid the debt in full, you step into the lender’s position, including any security the lender held over the borrower’s assets.

3

Right to contribution from co-guarantors

If two or more people guaranteed the same loan, each is liable for an equal share between themselves. If you pay more than your share, you can recover the excess from the others.

4

Discharge on variation or release

If the lender materially changes the loan terms without your consent, or releases the borrower, you are discharged for what follows. Check whether the guarantee form has you consenting in advance.

5

Revocation of a continuing guarantee

A continuing guarantee can be revoked as to future transactions by written notice to the lender, unless the contract excludes it. It does not touch what has already been advanced, but it stops the exposure growing.

These rights can be narrowed by the wording of the guarantee, and lenders’ standard forms usually try. General information, not legal advice; for a large guarantee, have a lawyer read the form before you sign.

Six Questions Before You Sign

1Can you afford to pay the whole loan yourself, today?

That is the real question a guarantee asks. If the honest answer is no, the answer to the request is also no.

2Is this a specific or a continuing guarantee?

A continuing guarantee covers future borrowing on the facility, including top-ups you were never told about. Insist on a specific guarantee for a fixed amount.

3Is there an advance-consent clause for variations?

If you consent in advance to any change the lender and borrower agree, you lose the Contracts Act protection on variation. Ask for it to be struck or limited.

4What is the borrower’s DSR with this loan included?

If the borrower is already near the limit, you are not a formality; you are the repayment plan.

5What is your own DSR with this loan counted against you?

Some lenders will treat the guaranteed instalment as a contingent commitment when you next apply for credit yourself.

6Does the lender hold a KPKT licence or a BNM licence?

A guarantee to an unlicensed lender is a guarantee of an illegal loan. Verify the licence before you sign anything.

If the borrower cannot qualify without you, it is worth asking why. Lenders decline for income, DSR, or conduct reasons, and a guarantor does not fix any of them; it only moves the risk to you. Our guide on getting a personal loan without a guarantor covers the alternatives the borrower should try first, and rejection reasons explains what the decline actually meant.

How to Be Released From a Guarantee

The question people search most is “how to remove guarantor from loan”. For the balance already owed, neither you nor the borrower can do it alone: a guarantee is the lender’s security, and only the lender can give it up. For future advances under a continuing guarantee, you can act yourself. These are the routes that work.

Borrower refinances elsewhere

The borrower takes a new loan with a different lender, settles the guaranteed facility in full, and the guarantee ends with it. Get written confirmation from the original lender that the account is closed and the guarantee discharged.

Substitute guarantor

The borrower proposes someone else, the lender assesses and accepts them, and signs a release for you. The lender is under no obligation to agree.

Partial settlement and release

Where the balance has fallen and the borrower’s conduct is good, some lenders will release a guarantor on request or on part-payment. Ask; put the request in writing.

Full settlement

The loan is repaid and the guarantee has nothing left to attach to. Keep the settlement letter indefinitely.

Revoke future advances by notice

If you signed a continuing guarantee, send the lender a written notice revoking it as to future transactions. New top-ups or drawings after the notice are not yours. The existing balance remains until repaid. Check the form for a clause excluding revocation.

Whatever the route, get it in writing

A verbal assurance from a branch officer that you are “no longer on the loan” is worth nothing when the borrower defaults three years later. Ask for a letter of release or a settlement letter naming you and the facility, and keep it with your important documents.

If the Lender Calls on You

Do not ignore the letter. A demand on a guarantor is the start of the same civil process a borrower faces: demand, suit, judgment, enforcement. Silence removes your room to negotiate.

Ask for the figures. You are entitled to a statement of the balance, the arrears, and the charges applied. Check the arithmetic against the guarantee you signed.

Check for a discharge. Was the loan varied, topped up, or rescheduled without your consent? Was the borrower released or given time in a way that prejudiced you? Those facts can discharge a guarantor, depending on the wording of the form.

Negotiate as a guarantor, not a debtor. Lenders will often accept a structured plan from a guarantor. Ask whether they will realise the borrower’s security first; they are not obliged to, but some will. Whatever you pay, record it; it is recoverable from the borrower.

Get advice early if the sum is large. The stages of debt recovery are the same for you as for the borrower, and the Legal Aid Department or a Bar Council legal aid centre can help if you cannot afford a lawyer.

Asked to Guarantee a Loan?

Read the form for “continuing” and “principal debtor”, ask the six questions above, and sign only if you could pay the whole balance tomorrow without hardship. If the borrower is a friend who needs a smaller, regulated loan instead, point them to a licensed lender.

This article is general information about Malaysian law and lending practice, not legal advice. The Contracts Act 1950 and Insolvency Act 1967 are amended from time to time, and the wording of each guarantee decides how the rules apply to it. Consult a lawyer before signing a large guarantee or responding to a demand.

Frequently Asked Questions

What exactly am I liable for as a loan guarantor in Malaysia?

Under the Contracts Act 1950, a guarantor's liability is co-extensive with the borrower's unless the guarantee says otherwise. That means the full outstanding balance, accrued interest, late charges, and the lender's recovery costs, not just the original loan amount. If the borrower stops paying, the lender can demand the whole sum from you without first exhausting every remedy against the borrower, unless the guarantee document limits that.

Does being a guarantor show on my CCRIS?

Yes. Facilities you have guaranteed appear in a separate section of your CCRIS report. They are not counted as your own debt while the borrower pays on time, but every lender you apply to can see them, and if the guaranteed loan falls into arrears that conduct becomes visible against your name. Many lenders also factor a guaranteed facility into their assessment of how much more you could absorb.

Can a guarantor be made bankrupt in Malaysia?

It depends on the type of guarantor. Under the Insolvency Act 1967, a "social guarantor" cannot be made bankrupt at all. A social guarantor is someone who guaranteed, without making a profit, an education loan, a hire purchase loan for a personal vehicle, or a housing loan for personal use. For any other guarantee, including a personal loan, a creditor needs the court's leave and must show it has exhausted all avenues of recovery against the borrower before petitioning against the guarantor.

How do I get released from a guarantee?

For the existing balance, only with the lender's agreement: the borrower settles or refinances the loan elsewhere so the facility closes; the borrower provides a substitute guarantor the lender accepts; the lender releases you on request or on part-payment after good conduct. There is one self-help exit: under the Contracts Act, a continuing guarantee can be revoked as to future transactions by written notice to the lender, so new advances after your notice are not yours. What has already been drawn stays your liability until it is repaid.

If I pay the lender as guarantor, can I recover the money from the borrower?

Yes. The Contracts Act gives a guarantor who pays a right of indemnity against the borrower and the right to step into the lender's shoes for any security the lender held. In practice, recovery depends on the borrower having assets or income, which is often the reason you were called on in the first place. Keep every payment receipt and the lender's demand letters; they are your evidence.

Can the lender change the loan terms without telling me?

Not without consequences. Under the Contracts Act, a material variation of the contract between lender and borrower made without the guarantor's consent discharges the guarantor for transactions after the change. The same applies if the lender releases the borrower or does something that impairs the guarantor's rights. Most guarantee forms try to contract out of this with a clause consenting in advance to variations, so read that clause before signing.

What happens to the guarantee if I die?

A guarantee for an existing debt does not die with you. The liability becomes a debt of your estate, which means it is settled from what you leave behind before anything passes to your family. For a continuing guarantee, the Contracts Act provides that the guarantor's death itself revokes it as to future transactions unless the contract says otherwise, so new advances after death are not covered; existing balances remain.

Borrow Responsibly — Things to Consider First

  • A personal loan is a debt with interest. Understand the full APR, total repayment, and tenure before you commit — not just the monthly figure.
  • Borrow only what you genuinely need. A larger loan or longer tenure means more total interest paid.
  • Keep your total monthly commitments within a comfortable debt-service ratio so repayment does not strain essentials.
  • Missed or late payments can lead to extra charges and affect your CCRIS/CTOS record and future borrowing.
